How We Operate

Getting An Advisal In a Criminal or Family Case

Step 1: Initial Contact

You can either reach out to us directly by telephone (617-449-1070) or email (contact@CrimImmAdvisal.com). Either way, we will need as much of the following information as possible:


  • Your client's exact immigration status (we can help you figure this out)


  • Your client's immigration history, including when they came to the U.S.


  • The exact subsection of the penal law at issue


  • An idea of what the DA / opposing party are willing to accept in plea bargaining (e.g. felony level, or type of crime)


  • A short, factual description of what your client is alleged to have done (not all consequences are based on the disposition of the case)


  • Confirmation of absolutely all prior criminal history, even if irrelevant to your case


  • Confirmation of whether your client has ever had any immigration encounters


Because your client's identity is not generally relevant (we advise on the fact pattern) we ask that you do not provide identifying information unless specifically needed. This makes the process quicker as we do not need to undertake a detailed conflict check before advising you.


Step 2: Quote for Services

Once as much of the information above as possible,  we will immediately provide a quote for our advice. The initial fee will always include:


  • Initial telephone advice
  • Written advisal
  • Follow up questions from written advisal
  • Advice on plea colloquy based on written advisal


Generally speaking, unless agreed otherwise the Initial fee does not include:

  • Advice on substantive case developments (substantial change in the fact pattern, additional charges)
  • Memos written for prosecutors or judges
  • Advice on any non-federal case (e.g. state prosecution)


Step 3: We Provide Initial Telephonic Advice

Once you have agreed the fee, we will initially provide telephonic advice to you, so we can ask more detailed questions and talk through possible substantive options. This is intended to give you the immediate advice needed on how to proceed in your case in advance of our written memo.


Step 4: We Provide a Detailed Email or Written Memorandum

Unless you confirm that a written advisal is not required, we will provide a detailed email memo, or standalone memorandum setting out all the possible options and consequences.


(Optional) Step 5: We Provide An Advocacy Memo for the Court / Opposing Counsel

In some cases, you may find it helpful for us to provide additional advocacy explaining the immigration situation in support of your efforts to avoid or mitigate the immigration consequences we have identified.
